Marketplace, Booking and Client Terms

This candidate document is provided for legal and operational review. It is not effective, does not replace any existing agreement, and must not be used to collect consent until TCW records final approval and a publication date.

The offer and checkout must identify the contracting parties and TCW's role. Unless TCW is expressly the seller or provider, the member offering or buying the work contracts directly with the other member. TCW provides discovery, records, communication, workflow and available payment support and does not become an employer, agent, manager, insurer or fiduciary merely by providing those tools.

Clients and bookers must disclose identity, role, work scope, location, schedule, compensation, expenses, usage rights, exclusivity, eligibility, working conditions and material risks. Applicants must accurately describe identity, experience, availability, authority and portfolio rights. No discriminatory criteria except a genuine, lawful occupational requirement documented in the listing.

Before work begins, parties should record deliverables, milestones, review rounds, acceptance, fees, taxes, expenses, cancellation, ownership and licence terms, confidentiality and safety requirements. A scope change should be accepted by authorized representatives in a durable record. TCW templates are tools, not legal advice or a substitute for specialized contracts.

The parties are responsible for determining whether a relationship is employment, independent contracting, agency, union-covered work or another status and for complying with wage, hour, immigration, child-labor, tax, insurance, permit and collective-bargaining rules. A TCW label does not decide legal classification. Features may be withheld where compliant classification or payment cannot be supported.

Only authoritative checkout and processor records establish paid, refundable or payout status. The total, currency, tax, platform fee, payment timing, payout conditions and any hold must be disclosed before authorization. No member may request passwords, authentication codes or complete card data, manipulate a receipt or redirect another member to a deceptive payment flow.

Parties must provide a safe, lawful environment; respect boundaries; avoid coercion and harassment; disclose hazardous, intimate, adult, medical, travel or security-sensitive conditions before agreement; and provide required accommodations. General TCW does not permit adult-service bookings. Emergencies should be directed to local emergency services, then reported to TCW when safe.

The recorded booking terms and mandatory law control cancellation. Parties must mitigate avoidable loss and preserve evidence. TCW may provide a case workflow, pause platform features or review processor evidence but does not guarantee recovery from another member. Chargebacks and legal claims must be truthful; abuse of either process may lead to enforcement.

A seller, advertiser or professional user may need to provide legal name, address, registration, tax, payment and contact information before offering to consumers. TCW must verify and display legally required trader information and provide traceability to regulators where applicable before enabling the relevant marketplace feature in a region.
