Draft for legal review · Not effective
Creator and Professional User Terms
These proposed terms supplement the master Terms when a member publishes or uses TCW for professional activity.
Not approved for publication or consent collection
TCW has not made this candidate effective. Final legal review, business approval, publication metadata and matching consent controls are still required.
Draft status
This candidate document is provided for legal and operational review. It is not effective, does not replace any existing agreement, and must not be used to collect consent until TCW records final approval and a publication date.
Portfolio and publishing controls
You choose which eligible work becomes public, subject to rights and moderation review. Private drafts are not public but remain subject to security, storage and legal requirements. Provide meaningful titles, credits, captions, transcripts or descriptions when reasonably possible and disclose synthetic or materially altered media when omission would mislead.
Applications and client work
Submit truthful applications and respect confidentiality and usage restrictions. Do not reuse client briefs, auditions, unreleased work or contact data beyond the purpose provided. Before work begins, confirm scope, compensation, expenses, schedule, rights, cancellation, safety and legal classification in a durable record.
Storefronts and products
Sellers are responsible for product descriptions, ownership, variants, required warnings, consumer information, taxes and lawful offers. TCW or a fulfillment provider may reject a design or product that violates rights, policy, safety or provider rules. A published product is not a guarantee of continuous availability.
Plans, quotas and team access
Plan pages must identify included applications, saved searches, portfolio brands, active listings, team seats, exports, credits and professional controls. Quotas and roles are enforced by server records. Teams must promptly remove access when a person leaves and remain responsible for authorized workspace actions.
Fees, payouts and taxes
The applicable transaction must disclose platform fees, processor fees, payout conditions, reserves or holds before commitment. No browser balance or editable profile field creates a payout right. Professional users are responsible for invoices, registration and taxes assigned to them, while TCW will perform withholding or reporting assigned to TCW by law.
Promotion and analytics
Paid promotion is labeled and does not guarantee reach, sales or bookings. Analytics are estimates based on recorded events and may be filtered for abuse or privacy. Do not present TCW metrics deceptively. Promotion credits are closed-loop, noncash and nontransferable under the disclosed plan rules.
Professional-user notice and changes
TCW will give professional users clear terms, reasons for material restrictions and notice of material changes as required. Final regional launch review must confirm any business-user mediation, ranking transparency, trader verification, data access and termination-notice duties that apply.
